1. Acceptance of Terms

By accessing and using Franko ("Service"), you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you should not use our Service.

2. Service Description

Franko is an energy offer comparison platform in Portugal that:

• Allows you to compare electricity and gas rates from various retailers
• Calculates savings estimates based on user-provided data
• Offers optional alerts when better offers appear
• Sends contract expiry reminders (optional)

The Service is free for end users.

3. Information Accuracy and Third-Party Offers

Information about rates and offers is obtained from licensed public sources, namely ERSE (Energy Services Regulatory Authority) and OMIE (Iberian Energy Market Operator). However, it is critical to understand the following limitations:

• We do not guarantee that information is always 100% up-to-date or complete, as it depends on third parties and may experience update delays.
• Offer prices may change after being presented on our platform. Franko has no control over price variations set by retailers.
• Savings calculations are estimates based on provided data and may differ from actual values depending on factors such as actual consumption, VAT rates, and specific contract terms.
• Offer availability is the responsibility of third-party data sources (ERSE, OMIE, retailers). Franko does not guarantee that any listed offer will remain available when you attempt to contract.
• Final contract conditions are defined by retailers and should be confirmed directly with them before signing.

4. Service Usage

By using the Service, you agree to:

• Provide true and accurate information
• Not use the Service for illegal or unauthorized purposes
• Not attempt to access restricted areas of the system
• Not interfere with the normal operation of the Service
• Not collect data from other users

5. User Account

Account creation is optional and only necessary to receive alerts. If you create an account:

• You are responsible for maintaining the confidentiality of your credentials
• You must notify us immediately of any unauthorized use
• You can delete your account at any time

6. Alerts and Communications

If you opt to receive alerts:

• You will receive emails when we find offers matching your preferences
• You can disable alerts at any time
• We do not send spam or unsolicited communications

7. Intellectual Property

The Service and all its content (except third-party data) are property of Franko and are protected by copyright and other intellectual property laws.

A limited license is granted to use the Service for personal and non-commercial purposes.

8. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is", without warranties of any kind.
• We are not responsible for decisions made based on Service information.
• We are not responsible for contracts entered into between users and energy retailers.
• We shall not be liable for any indirect, incidental, or consequential damages.

9. Indemnification

You agree to indemnify and hold Franko harmless from any claims, damages, or expenses resulting from your use of the Service or violation of these Terms.

10. Changes to Service and Terms

We reserve the right to:

• Modify or discontinue the Service at any time
• Update these Terms when necessary
• Notify about significant changes through the site or email

Continued use of the Service after changes constitutes acceptance of the new Terms.

11. Applicable Law and Jurisdiction

These Terms are governed by Portuguese law. Any dispute will be submitted to the competent Portuguese courts.

12. General Provisions

• If any provision is deemed invalid, the remaining provisions remain in force.
• Failure to enforce any right does not constitute a waiver of that right.
• These Terms constitute the complete agreement between the parties regarding their subject matter.
